So, I was just contacted by a lawyer, saying that I was being sued for an accident that I was in over 2 years ago. I was wondering what the statute of limitation in Texas for auto accidents was and what that entailed. Does the person just have to file suit against me or do I have to be notified? It was definitely over 2 years ago at this point. March 2006 is when the wreck occurred. So, I was caught a little off guard when his lawyer contacted me. Thanks in advance

The Statute of Limitations for Texas is 2 years for both property damage as well as bodily injury.
Its possible that the other person filed the lawsuit prior to the 2 yr mark, and you are just being notified now.Generally, the statute of limitations for both personal injury and property damage in the State of Texas is two years. It is possible that a lawsuit was filed, but you were never notified of the suit. In this case, you are going to need the help of a lawyer to sort out the facts. In most states, the Statute of Limitations must be affirmatively pleaded in answer to a lawsuit. If you were insured at the time of the accident, contact the insurance agent or company that covered the car and you at the date of the accident. They will provide a lawyer to aid you, if they had knowledge of the accident after it happened.
